Terms of Service

Please read these Terms of Service carefully before using the service.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Seoul Oncology Creative Platform (the “Service”) provided by Seoul Oncology Creative Lab (“we,” “us,” or “our”). By creating an account, connecting a device, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility & Accounts

  • You must have the legal capacity to enter into a binding agreement to use the Service.
  • You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
  • You must provide accurate, current, and complete information and keep it updated.

3. Permitted Use & Restrictions

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Reverse-engineer, decompile, or attempt to derive source code except as permitted by law.
  • Access or use the Service to build a competing product or service.
  • Interfere with or disrupt the integrity or performance of the Service or related systems.
  • Upload malicious code, violate intellectual property rights, or engage in unauthorized data scraping.

4. Wearables & Biometric Data (e.g., Fitbit)

If you connect wearable devices or third-party health platforms (such as Fitbit), you authorize us to access, process, and store data made available through those integrations to provide the Service, including features such as analysis of cancer patient treatment progress based on biometric data. You are responsible for complying with the third-party’s terms and for managing permissions in their apps. We may provide insights or analytics for informational purposes only and not as medical advice.

5. Privacy & Data Protection

Our processing of personal data is described in our Privacy Policy, which is incorporated into these Terms. By using the Service, you consent to such processing and represent that you have the necessary authorizations for any data you provide.

6. User Content & License

You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content as reasonably necessary to operate and improve the Service. You represent that you have all rights necessary to grant this license.

7. Fees, Trials & Taxes

Some features may require paid subscriptions or usage-based fees. Prices and billing terms will be presented at purchase. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes, which you are responsible to pay.

8. Third-Party Services

The Service may display, integrate, or link to third-party services (e.g., wearable platforms, analytics). We do not control and are not responsible for third-party content, policies, or practices. Your use of such services is at your own risk and subject to their terms.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DATA OR INSIGHTS WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Seoul Oncology Creative Lab and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service; (b) your content; or (c) your breach of these Terms.

12. Suspension & Termination

We may suspend or terminate your access to the Service at any time with or without notice for conduct that we believe violates these Terms, is harmful to other users, or creates legal risk. Upon termination, your right to use the Service ceases immediately.

13. Changes to the Service & Terms

We may modify the Service or these Terms from time to time. Material changes will be notified by posting an updated version with a new effective date or by other reasonable means. Your continued use after the effective date constitutes acceptance of the changes.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of competent courts in Seoul, Korea, unless otherwise required by mandatory law.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision is held invalid, the remaining provisions will remain in full force.
  • No Waiver: Our failure to enforce any right is not a waiver of future enforcement.
  • Assignment: You may not assign these Terms without our prior written consent.
